Hottagrill Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Hottagrill LLC’s (“Hottagrill,” “we,” “our,” or “us”) services, including our website, food truck and restaurant operations, catering services, promotions, events, and any transactions you make with us.

By placing an order, booking an event, joining our mobile messaging program, or otherwise engaging with Hottagrill, you agree to these Terms. If you do not agree, do not use our services.


1. Our Services

Hottagrill operates as a food truck, catering provider, and (when applicable) brick-and-mortar restaurant. Our offerings include:
 

  • In-person and online ordering for pickup, delivery, and dine-in

  • Catering and private event services

  • Promotional campaigns, contests, and loyalty programs
     

Menu items, pricing, and promotions may vary by location and are subject to change without notice.

2. Orders & Payment

a. Payment Methods

We accept cash, credit/debit cards, mobile payments, and approved third-party ordering platforms. Payment is required at the time of order unless otherwise agreed in writing.

b. Online Orders

You are responsible for ensuring your order details are correct before submitting. We are not responsible for incorrect orders caused by user error.

c. Pricing & Taxes

Prices are in U.S. dollars and subject to applicable taxes and fees. We reserve the right to adjust prices without prior notice.

3. Refunds & Cancellations

a. In-Person Orders: All sales are final. If you experience an issue, please notify us immediately.

b. Catering/Private Events: Deposits are non-refundable unless otherwise agreed in writing. Cancellations must be made at least [Insert Timeframe] in advance for any potential refund.

c. Online Orders: Refunds for third-party platform orders must be requested through that platform.

4. Allergens & Dietary Restrictions

We prepare food in kitchens that may contain allergens including, but not limited to: peanuts, tree nuts, dairy, wheat, soy, eggs, shellfish, and sesame. While we take precautions, we cannot guarantee the absence of cross-contact. Customers are responsible for notifying us of any allergies before ordering.

5. Promotions, Loyalty Programs & Contests

From time to time, we may offer special promotions, discounts, contests, or loyalty programs. Participation is subject to:

  • Eligibility requirements in the specific promotion

  • Compliance with applicable laws

  • Our right to modify, suspend, or terminate promotions at any time without notice
     

Rewards, discounts, and free items have no cash value and are non-transferable.

6. Mobile Messaging Program

a. Program Description

We may send you:

  • Order confirmations and updates

  • Event announcements

  • Promotions, specials, and loyalty rewards

  • Limited-time offers and contests
     

Messages may be sent using automated technology. Consent to receive automated messages is not a condition of purchase.

b. Opt-In & Consent

By providing your mobile number via our website, in person, or through a third-party platform, you consent to receive recurring text messages from us at that number. You must be 18 years or older (or the age of majority in your jurisdiction) to opt in, or have parental/guardian consent.

c. Opt-Out Instructions

You can cancel at any time by replying STOP to any Hottagrill message. After you send STOP, you may receive a confirmation message to verify your opt-out. Transactional or service-related messages (e.g., order updates) may still be sent.

e. Message Frequency

Frequency varies based on promotions, events, and your interactions with us.

f. Message & Data Rates

Message and data rates may apply according to your mobile carrier’s plan.

g. Supported Carriers

Our messaging program works with most major U.S. carriers, but we cannot guarantee service with all carriers.

h. Privacy

Your mobile number and related data will be handled according to our Privacy Policy. We do not sell your personal information.

i. Liability Limitation

To the fullest extent permitted by law, we are not liable for delayed or undelivered messages, or damages resulting from participation in the messaging program.

7. Intellectual Property

All content on our website, menus, social media, and marketing materials — including our name, logos, designs, recipes, and photography — are owned by Hottagrill or used with permission. You may not use, reproduce, distribute, or modify our content without written consent.

8. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services.

  • Our total liability for any claim shall not exceed the amount you paid for the order or service in question.
     

9. Indemnification
 
You agree to defend, indemnify, and hold harmless Hottagrill, its owners, employees, and affiliates from and against any claims, liabilities, damages, costs, or expenses arising from your use of our products or services, violation of these Terms, or infringement of third-party rights.
 
10. Third-Party Services
 
Our website, ordering systems, and promotions may link to or integrate with third-party services. These services have their own terms and privacy policies. We are not responsible for their actions or practices.
 
11. Governing Law
 
These Terms are governed by the laws of North Carolina, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in [Insert County], North Carolina.
 
12. Changes to These Terms
 
We may update these Terms at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
